TERMS OF USE

ARTICLE 1. PURPOSE

These Terms of Use cover the rules of access to www.odice.com (“the Website”) which is the exclusive property of ODICE.

ODICE reserves the right to amend these Terms of Use at any time and without notice where necessary to reflect changes to the Site and its use. Any amendments will apply as soon as they are uploaded to Website. Users should therefore check these Terms of Use regularly.

 

ARTICLE 2. DEFINITION

Any person accessing the Website and the material published on it, in any capacity, from any location, by any means of connection and for whatever purpose, is a Website user (“the User”).

By using this Website, the User is deemed to have read and understood these Terms of Use and to have accepted them unreservedly.

 

ARTICLE 3. ACCESS TO SERVICES 

The User must register on the Website to access product information.

The User must have a valid email address and password. The password, which is personal to the User, must be confirmed.

This allows the User permanent and secure access to product information.

The User is responsible for the use of the user name and password and acknowledges that any connection or data transfer carried out using his user name and password are deemed to have been carried out by the User.

The User must give his surname, first name, postal address, telephone number and email address.

Once registration is complete, a confirmation email is sent to the email address provided by the User.

Any change to the information provided by the User will be updated on-line one working day after the change has been made.

 

ARTICLE 4. LIABILITY AND FORCE MAJEURE

ODICE will use reasonable endeavours to ensure uninterrupted Website access unless there is a force majeure event or an event outside its control, or in case of any necessary maintenance or improvements to the Website which may be carried out without notice.

ODICE is not liable for any interruption to service or for any consequential loss to the User or any third parties, except direct loss resulting from a serious or deliberate breach by ODICE.

Each User is responsible for taking appropriate measures to protect against the contamination of its data, software and hardware from viruses that may circulate via the Website or the information published on it.

 

ARTICLE 5. HYPERLINKS

The Website may contain hyperlinks to other websites. These links are for information purposes only and ODICE is not liable for the content or terms of use of the websites that those hyperlinks lead to.

Prior written permission must be obtained from ODICE before putting in place a hyperlink to the Website.

 

ARTICLE 6. INTELLECTUAL PROPERTY

All intellectual property rights, particularly copyright, arising from the Website, its content, still or animated images, photographs, sounds and all material that makes up the Website, are either owned by ODICE or ODICE has been granted authorisation to use such material.

Any use, whether commercial or private, total or partial, including downloading, copying, reproducing, distributing, transferring, diffusing, adapting, translating or representing, either at present or in the future, is prohibited without the prior written authorisation of ODICE and may lead to legal action under articles 335-2 onward of the Intellectual Property Code subject to the application of article L122-5 of the aforementioned Code.

Any authorised use of material that forms part of or features on the Website must be without distortion, modification or amendment of any kind.

 

ARTICLE 7. PERSONAL DATA

ODICE undertakes to process personal data in accordance with the laws and regulations in force, in particular (EU) 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “General Data Protection Regulation”) and Law No 78-17 of 6 January 1978 on technology, files and freedoms modified by Law No 2018-493 of 20 June 2018 on data protection (the “Technology and Freedoms Law as amended”)

The User acknowledges and accepts that his personal data may be collected on the Website and used by ODICE who is a data controller for the purposes of the General Data Protection Regulation. The data collection forms state whether the information required is compulsory or optional.

Personal data may be transferred outside the European Union in the following circumstances:

  • When distributing the Newsletter. ODICE undertakes to use software that complies with the General Data Protection Regulation.
  • To process enquiries and track interest in ODICE products for Users in the United States and in the Commonwealth of Independent States (CIS), personal data may be communicated to ODICE’s official distributors who are based in the United States or in the CIS. It is ODICE’s policy to request that its official distributors process personal data in accordance with ODICE's confidentiality and security undertakings. 

ODICE uses tracking technology such as cookies to enhance the Website and adapt it to the User’s requirements.

ODICE will only use Users’ personal data for the use of the Website.

In accordance with the General Data Protection Regulation, the User has a right to access, correct, erase, restrict the processing and transfer his personal data which is stored in ODICE’s files.

ARTICLE 8. COOKIES

When using the Website a cookie stores information about the User's browsing habits (pages viewed, date and time). ODICE can read this information when the User next visits. ODICE ensures, where possible, that the service providers who measure website usage comply strictly with the Technology and Freedoms Law as amended and undertake to implement appropriate measures to protect and secure the confidentiality of the data.

ODICE uses the Google Analytics service provided by Google Ireland Limited, a European filial of the American group, Google LLC, whose certified Privacy Shield  offers a sufficient level of protection for personal data.

This cookie does not identify the User.
